Symantec may amend these Terms from time to time, so please re-read the Terms
if you see that they have been amended since the last time you read them. The
amended terms will automatically be effective ten days after they are initially
posted on our site. These Terms may not be otherwise amended except in a
writing signed by you and Symantec. We reserve the right to deny access to the
Service to any user who, in our sole discretion, has violated any of these
Terms.
BY CONTINUING TO USE THE WEB SITE or any of our service, YOU ARE INDICATING YOUR
AGREEMENT TO BE BOUND BY THE TERMS.

Our Service.
Symantec is inviting you, a member of the Internet community, to become an
DeepSight Analyzer participant. All participants must first register for
membership and use a secure password. Participants will then receive a copy of
DeepSight Extractor, our firewall and intrusion detection system log-parsing
tool, and access to a secure, personalized, web-based incident console. Your
download and use of this software is subject to Symantec’s license terms, which
are based on a Berkeley Software Distribution (BSD) license for the purpose of
permitting certain modifications. The incident console is comprised of several
time saving utilities that enable you to track your intrusion incidents, create
personal incident reports, and generate attacker notification messages through
an easy-to-use Incident Wizard. Our DeepSight Extractor tool will reformat and
send your firewall and intrusion detection system (“IDS”) logs to your
DeepSight account using SSL technology. Use of the DeepSight Extractor tool
also requires these system requirements:

DeepSight Extractor integrates into the following firewall and IDSs on the
following operating systems, as a client-side executable:

DeepSight Extractor reformats and then sends logs over SSL to the user’s
DeepSight account. The log output is in XML format.

DeepSight Extractor is provided with full source under a BSD license so users
may modify the tool to best work with their systems.

Changes to our Service.
Symantec reserves the right to change or discontinue, temporarily or
permanently, any part of our Service without notice, without any liability to
you or any third party. Please keep in mind that we may occasionally cancel
accounts that have been inactive for extended periods time. So, remember to
visit us often!
Your Privacy.
Symantec respects your privacy. Because Symantec recognizes the need for
discretion when dealing with incidents, we do not require you to provide any
personal or identifying information when applying for DeepSight Analyzer
membership. Instead we ask for demographic information (such as company size,
industry category, and job category) so that the logs can be used to show
geographic or industry patterns that will benefit our users’ network security.
We want to enable you to take advantage of what the incident information has to
reveal, rather than cause you and your company embarrassment and further
break-ins or attempts. The information you provide also enables us to provide
you with the Service and any updates about our site, and compile demographic
statistics for our reports. The complete terms of our
Privacy Policy are part of this agreement so please take a few moments
to read them.
Our Rules.
You must be at least 18 years old and able to form legally binding contracts
under applicable law to use our Service. You agree that any information you
provide in response to Symantec’s registration and other forms will be true,
accurate, current and complete. You agree not to misrepresent any demographic
or other information that you submit to Symantec. You also agree that any
firewall or IDS log information that you submit to our site has been
legitimately reported and not fabricated. By submitting any information to us,
you grant us the right to use this information to provide the Service to you,
and for any other purpose that is consistent with our
Privacy Policy.
If you become a registered DeepSight Analyzer member, you will choose a password
for accessing the information you store on our site. You are responsible for
maintaining the confidentiality of your password and account and are fully
responsible for all activities that occur using your password or account.
Please notify us immediately of any unauthorized use of your password or
account or any other breach of security. Symantec will not be liable for any
loss that you may incur as a result of someone else using your password or
account, either with or without your knowledge. You may not use anyone else’s
password at any time.
You may not use any information obtained on our web site for any commercial
purposes (other than to manage your own firewall and IDS logs and to order
reports from Symantec). You may not link to any part of our site or
frame or display any of our content on another web page, without our prior
written permission. You agree not to use our website or anything on it for
illegal purposes or in any way that infringes upon the rights of others or
violates any law. You also agree not to interfere with the proper working of
any of the following: the Symantec site, the DeepSight Analyzer site, or any
services available, accessible or offered through these sites. You further
agree that you will not take any action that imposes, in Symantec’s sole
discretion, an unreasonable or disproportionately large load or burden on the
site or the Symantec infrastructure.
User Submissions to Symantec.
Symantec provides areas for personal feedback in our DeepSight Analyzer incident
reporting feature. Symantec does not want to receive confidential or
proprietary information from you through this website or otherwise. You agree
that no information or material sent to Symantec over this website or otherwise
will be deemed to be confidential. By sending SecrityFocus any information or
material, including any firewall and IDS log information, you assign all rights
and interests in such information to Symantec. You also agree that Symantec
shall be free to use for any purpose any concepts, ideas, know-how, or
techniques that you send to us. We will use any information you submit in
accordance with the terms of our privacy policy.
If you choose to report your incidents or use any other messaging forums that
Symantec may make available, you agree that you will not submit any messages
that would be deemed offensive or illegal, as determined in Symantec’s sole
discretion. You also agree not to use any vulnerability divulged through any
other member’s reports you receive to attack or interfere with anybody else’s
systems.
Copyrights, Trademarks, and Other Intellectual Property.
You acknowledge and agree that Symantec and its licensors own all rights to this
website and the content displayed on the site, including but not limited to the
logs you upload to your account and any information that you post. These rights
are enforceable under U.S. and international laws and treaties. © 2001

information in your personal account. You may not copy, reproduce, distribute,
publicly display, or create derivative works from any other content on this

Disclaimer of Warranties.
Our goal is to make your experience with Symantec and our DeepSight
service a pleasurable one. However, we cannot always foresee or anticipate
technical or other difficulties. Therefore, YOUR USE OF THE SERVICE, INCLUDING
THE DeepSight Analyzer, WEBSITE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED
ON AN "AS IS" AND "AS AVAILABLE" BASIS. SYMANTEC EXPRESSLY DISCLAIMS ALL
WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED

Indemnification.
You will indemnify and hold harmless Symantec from and against all claims
(including but not limited to paying attorneys’ fees) arising out of or caused
by your use of the Service, your violation of the Terms, or your infringement
of any intellectual property or other right of anyone.
General Provisions.
These Terms and performance by the parties hereunder will be construed in
accordance with the laws of the State of California, U.S.A., without regard to
provisions on the conflicts of laws. You and Symantec consent to the exclusive
jurisdiction of, and venue in, the state and federal courts located in Santa
Clara County, California, U.S.A. you will not assign any order, these Terms or
any rights hereunder without the prior written consent of Symantec. Symantec
will not be responsible for failure to perform due to causes beyond its
reasonable control. These Terms, together with the DeepSight
Privacy Policy, and any applicable Symantec software license
agreements, constitute the entire agreement between Symantec and you with
regard to the Service and supersede all previous communications,
representations and agreements, whether oral or written, between you and
Symantec with respect to the subject matter hereof. The failure by Symantec to
enforce at any time any of the provisions in these Terms will in no way be
construed as a waiver of such provisions.
In the event that any portion of this agreement is held unenforceable, the
unenforceable portion will be construed in accordance with applicable law as
nearly as possible to reflect the original intentions of the parties, and the
remainder of the provisions will remain in full force and effect.
